Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 307/34 and other allied sections of the Indian Penal Code.
Learned counsel appearing for the petitioners submits that co-accused Ram Ayodhya @ Ram Ayodhya Mahto who is alleged to have assaulted the victim with iron rod, has already been allowed pre-arrest bail by a co-ordinate bench of this Court vide order dated 6.1.2022, passed in Cr.Misc.No. 18672 of 2021 and petitioner 1 is alleged to have assaulted the victim with lathi
Patna High Court CR. MISC. No.64905 of 2021(2) dt.14-07-2022 2/2 and there is no allegation against rest petitioners. It is further submitted that the FIR was lodged after delay of three months and there is no plausible explanation of delay. Petitioners have got no criminal antecedent.
Considering the fact that similarly situated co-accused has already been allowed bail by a co-ordinate bench of this Court, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Saran at Chapra in Rivilganj Police Station Case No. 295 of 2019, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
