ANJANA MISHRA ORAL ORDER 25-11-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is in custody since 05.09.2016 in connection with N.T.P.C. Case No. 49 of 2015 registered for the offences punishable under Sections 302 and 120B/34 of the Indian Penal Code and under Section 27 of the Arms Act. Learned Counsel for the petitioner submits that though the petitioner has been named in the FIR, yet the entire allegations are based on suspicion. It is further submitted that the petitioner had earlier approached this Court for anticipatory bail, but since he was permitted to surrender before the court below, the petitioner has approached the court below, after surrendering, which was again rejected. Patna High Court Cr.Misc. No.48551 of 2016 (2) dt.25-11-2016 further submits that brother of the petitioner, namely, Chandan Kumar who had come to this court earlier with similar allegation, which has also been made out against the present petitioner, has been released on bail in Cr. Misc. No. 14484 of 2016 vide order dated 08.04.2016.
Considering that the petitioner's case stands absolutely on similar footing, let the above named petitioner, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with N.T.P.C.
