This application is for grant of bail in connection with Bettiah Mufassil P.S.Case No.292 of 2016 for the offence under Sections 147, 148, 149, 323, 324, 307, 302, 447, 504 and 506 of the Indian Penal Code.

Submission of the learned counsel for the petitioner is that there is no allegation of assault against this petitioner and he has also received injuries. The petitioner is in custody for about eight months.

Heard learned A.P.P. also, who has opposed the prayer for bail stating that he is the main instigator and called other three accused persons, who assaulted the informant.

Patna High Court Cr.Misc. No.5776 of 2017 (2) dt.17-02-2017 2/2 Having heard both sides. In view of the allegation, as aforesaid, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the commitment proceeding and the petitioner may renew his prayer for bail after framing of charges in this case. With the aforesaid observation, this application is dismissed.
