The petitioner, who is in custody, seeks bail in connection with Darbhanga P.S.Case No. 287 of 2016 registered under Sections 420,409, 467, 408, 471, 379 and 120B of the Indian penal Code.
The prosecution case, in brief, is that the petitioner is an employee of SIS Cash Company and he was engaged for carrying and loading the cash in the ATMs of the State Bank of India. On a report from a particular ATM, the CPU was found missing. The petitioner sent some persons including the custodian of the area to verify cash and on verification Rs.10,61,500/- was
Patna High Court Cr.Misc. No.45848 of 2016 (6) dt.08-02-2017 2/2 found missing from the ATM.
It is submitted that the only allegation against this petitioner is that he entrusted Sundar to go there and verify the ATM with the custodian of the local area and the police has recovered the stolen money from the possession of Shivam Kumar and Sundar and this petitioner has been in custody in this case since 25.07.2016 and has no criminal antecedent. Having considered the aforesaid facts and circumstances, let the petitioner, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned C.J.M., Darbhanga in connection with Darbhanga Sadar P.S.Case No. 287 of 2016.
