ANJANA MISHRA ORAL ORDER 14-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in GRP(SPL) P.S. Case No.38/13 for the offences under Sections 341, 342, 323, 379, 307 and 120(B)/34 of the I.P.C. Earlier case diary in the present case called for has since been received.

Learned counsel for the petitioner submits that no incident had taken place and there is no material on record to implicate this petitioner in the present case. It is further submitted that from the location of mobile it is evident that at the time occurrence the petitioner was at Darbhanga. It is further submitted that CCTV footage shows that the petitioner was standing near an A.T.M.

Patna High Court Cr.Misc. No.34011 of 2015 (6) dt.14-12-2015 2/2 Central Bank, Darbhanga Tower Branch at the relevant point of time.

Considering the nature of allegation made against the petitioner and that there has been history of litigation between the parties and they are agnates, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the J.M., (Railway), Samastipur, in GRP(SPL) P.S. Case No.38 of 2013 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
