JUSTICE SANJAY PRIYA ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner, Union of India and the learned A.P.P. for the State. The Petitioner seeks bail in Kundwachainpur P.S Case No. 113 of 2016 instituted for the offence under Section(s) 272, 273 of the Indian Penal Code and Section 30(a), 37(a) of the Bihar Excise(Amendment) Act, 2016. It is alleged that 17.4 litres of Nepali liquor has been recovered from the possession of this petitioner. It has been submitted that petitioner has clean antecedent and he is in custody since 08.11.2016. Keeping in view the clean antecedent and the period spent in custody by the petitioner, prayer of the petitioner for bail is allowed. Let the Petitioner, above named, be released on
Patna High Court Cr.Misc. No.8845 of 2017 (2) dt.18-03-2017 2/2 bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran in connection with Kundwachainpur P.S. Case No. 113 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
