This is a petition for grant of regular bail for offences under Sections 341, 323, 307 and 504/34 of the Indian Penal Code and subsequently Section 302 of the Indian Penal Code added.

Accusation against the petitioner is that he assaulted to the deceased with farsa, as a result whereof the victim died after five days during the course of his treatment.

The petitioner is in custody since 02.03.2011. earlier prayer for bail of this petitioner was refused by this Court in Cr. Misc. No. 7400 of 2012 with direction to the learned trial Court to expedite the trial.

Submission of the petitioner is that there is no allegation of repetition of blow and the trial is still pending though the petitioner is in custody since about six

Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Sessions Trial No. 526 of 2011 arising out of Ladania P.S. Case No. 30 of 2011 to the satisfaction of the Additional Sessions Judge, VI, Madhubani, or successor Court with the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
