2. The petitioner is in custody in connection with S.Tr. No. 133 of 2024 arising out of Masaurhi P.S. Case No. 157 of 2021 for the offence punishable under Sections 304(B) and 34 of the Indian Penal Code, lodged on 21.03.2021 by the informant Dinesh Bind.

3. As per the prosecution story, the informant alleged that he had married his daughter, Runti Devi with this petitioner, in accordance with hindu rituals. It has been further alleged that the in-laws of his daughter used to demand a motorcycle and chain in dowry and for that they tortured her. It has been further alleged that on 20.03.2021, the deceased Runti Devi informed the informant about assault being made to her and thereafter next day, he came to know that husband Niranjan Bind, father in

Patna High Court CR. MISC. No.52002 of 2025(6) dt.30-01-2026 2/2 law Rama Bind, and his wife as well as brother-in-law Prince Kumar, committed her murder by strangulation. Accordingly, the F.I.R..

4. Earlier, the bail application of the petitioner was rejected on 12.07.2023 in Cr. Misc. No. 32441 of 2023, now the fresh petition has been filed.

5. A report was called for from the Trial Court and the delay has been recorded as the Presiding Officer is being on leave due to bereavement in the family and an undertaking has been given that as the case is fixed for argument, the same shall be concluded thereafter.

6. In that background, directing the Trial Court to take the matter to its logical conclusion at an earliest, for the present, this Court is inclined to extend him privilege of bail.

7. Accordingly, the bail application stands rejected. (Rajiv Roy, J) vinayak/- U T
