2. The petitioners in the writ application have prayed for following reliefs:

"i) To issue a writ/order/direction in the nature of certiorari for setting aside the Letter has contained in Memo No.2036 dated 21.12.2024 issued under signature of Director Primary Education, Education Department, Govt. of Bihar, Patna by which the provisional appointment letters issued to the petitioners has been cancelled and further direction has been given to all the District Education Officer to post the exclusive teachers including the petitioners at the place/School where they were originally/earlier posted. (Annexure-12)

39/112 ii) To issue a writ/order/direction in the nature of certiorari for setting aside the provisional appointment letters issued to the extent by which the provision of Amended Rule -2024 has been wrongly applied in the case of the petitioners.

iii) To issue a writ/order/direction in the nature of mandamus, directing the respondent authorities to give effect to the earlier provisional appointment letter dated 20.11.2024 and further post the petitioner in the allotted Districts in accordance with the provisions of unamended 2023 rules.

iv) To issue a writ/order/direction in the nature of mandamus, directing the respondent authorities to issue provisional appointment letter in favour of the petitioner no.5,12,18,22,25,31,32,33,40,48,64,67,68,70 ,81,86 and 88 similar to the other petitioners on basis of the merit list and further post the petitioners in the allotted districts in accordance with the provisions of 2023 rules.

v) To hold and declare that the respondent authorities are duty bond to complete the process of constitution of cadre of exclusive teachers in accordance with Rules called Bihar School Exclusive Teachers Rules, 2023.

vi) To hold and declare that Bihar State Exclusive Teacher (Amendment) Rule, 2024 is not applicable in relation to the process of constitution of cadre of exclusive teachers which has already been initiated prior to coming into force of Amendment Rules. 2024.

vii) To pass ex-parte /ad-interim relief during the pendency of the writ application restraining the respondent authorities from filling the seats in the Schools in the Districts allotted to the petitioners and or directing the respondent authorities to reserve the posts of teachers in the schools for the petitioners in the districts allotted to them."

Learned counsel for the petitioners submits that the petitioners were initially appointed as Local Bodies Teachers as per the provisions of Bihar Panchayat Primary Teacher (Appointment and Service Conditions) Rule, 2012 and their respective appointment letters have been brought on record as Annexure-P1 series. It is submitted that all the petitioners have been serving in Government Schools situated in districts other than their home districts and have continuously discharged their duties in accordance with the Rules and Government guidelines without any complaint.

Learned counsel further submits that the State Government, in exercise of powers conferred under Article 309 of the Constitution of India, framed the Bihar State School Teacher (Appointment, Transfer, Disciplinary Proceeding and Service Condition) Rules, 2023, which came into force on 10.04.2023 and has been brought on record as Annexure-P2. It is contended that under the said Rules a policy decision was taken by the State Government with regard to appointment, transfer and service conditions of School Teachers and, significantly, a provision was introduced enabling transfer/posting of teachers in their home districts.

41/112 It is further submitted that thereafter the State Government framed another set of Rules, namely the Bihar School Exclusive Teachers Rules, 2023 (hereinafter for brevity, referred to "Unamended Exclusive Teachers Rules, 2023"), for the teachers employed by local bodies, with the object of bringing them at par with School Teachers appointed under the Bihar State School Teacher (Appointment, Transfer, Disciplinary Proceeding and Service Condition) Rules, 2023. The said Rules have been brought on record as Annexure-P3.

Learned counsel for the petitioners submits that Rule 2(1)(vi) of the "Unamended Exclusive Teachers Rules, 2023" defines "Exclusive Teachers" to mean all serving teachers employed by local bodies who are covered under the relevant Local Bodies Teachers Rules, 2020 and who have passed the competency test under Rule 4 of the said Rules. It is further submitted that Rule 3 of the said Rules provides that all teachers employed by various tiers of local bodies shall be required to pass a competency test under Rule 4 and upon qualifying the same and joining the allotted schools, they shall be known as "Exclusive Teachers". It is contended that the Rules further provide that at the time of appearing in the competency test, teachers were required to furnish three choices of districts where they desired to serve and

42/112 the districts were to be allotted on the basis of merit/rank obtained in the competency test. Rule 4 specifically contemplated that the Department, through a Government agency, would conduct the competency test and that the candidates would furnish three district preferences while applying for the said examination. It is contended that district allotment was an integral and substantive part of the statutory scheme under the "Unamended Exclusive Teachers Rules, 2023".

It is further submitted that vide Notification dated 15.01.2024, the State Government authorized the Bihar School Examination Board (BSEB) to conduct the competency test under Rule 4 of the "Unamended Exclusive Teachers Rules, 2023", which notification has been brought on record as Annexure-P4. Thereafter, vide Memo No.139 dated 23.01.2024, detailed guidelines were issued regarding the conduct of the competency test (Annexure-P5).

6. Learned counsel submits that Clause-10 of the said guidelines specifically provided that after qualifying the competency test, a passing certificate would be issued by the BSEB and Clause-12(v) further stipulated that at the time of submission of the application form, the local bodies teachers were required to provide three district preferences and the districts were

43/112 to be allotted by the BSEB, whereas schools were to be allotted by the Department.

It is further submitted that pursuant thereto, the BSEB issued Advertisement dated 25.01.2024 inviting applications from Local Bodies Teachers for appearing in the competency test under Rule 4 of the "Unamended Exclusive Teachers Rules, 2023" (Annexure-P6). Learned counsel submits that Clause-11 of the advertisement also reiterated the requirement of furnishing three district preferences and Clause-18 contemplated counselling and document verification after declaration of results and prior to allotment of schools.

7. Learned counsel for the petitioners further submits that all the petitioners, being eligible Local Bodies Teachers governed by the "Unamended Exclusive Teachers Rules, 2023", submitted their applications within the stipulated period along with all requisite documents and while submitting their applications, each of the petitioners furnished three district preferences in terms of Rule 4 of the said Rules, the guidelines dated 23.01.2024 and the advertisement dated 25.01.2024. It is further submitted that all the petitioners appeared in the competency test conducted in February, 2024 and all of them were declared successful. Their respective score cards/result cards issued by the BSEB have been

44/112 brought on record as Annexure-P7 series. Learned counsel submits that the result cards themselves reflected the districts allotted to the petitioners in accordance with their merit and district preferences under the "Unamended Exclusive Teachers Rules, 2023".

8. Learned counsel further submits that thereafter the petitioners were called for counselling and document verification and all the petitioners duly participated therein. It is next submitted that all their documents were verified by the concerned District Education Officers and status reports confirming such verification were also issued (Annexure-P8). It is contended that after completion of counselling and verification, the Director, Primary Education, Government of Bihar issued Memo No.1590 dated 15.11.2024 directing issuance of provisional appointment letters to all successful Exclusive Teachers on 20.11.2024 (Annexure-P9), pursuant thereto provisional appointment letters dated 20.11.2024 were issued to most of the petitioners by the District Education Officers of the allotted districts, except in some cases where such letters could not be issued for administrative reasons. The said provisional appointment letters have been annexed as AnnexureP10 series. It is further contended that the appointment letters themselves specifically recorded that the appointments had been

45/112 made under the "Unamended Exclusive Teachers Rules, 2023" and that the district allotment had been made on the basis of merit and district preference in accordance with Rule 4 of the said Rules.

9. Learned counsel for the petitioners further submits that with issuance of provisional appointment letters, the entire selection process stood substantially concluded and only the ministerial/formal act of allotment of schools within the allotted districts remained. It is submitted that the petitioners, therefore, acquired a legitimate expectation that they would be permitted to join as Exclusive Teachers in the allotted districts in accordance with the "Unamended Exclusive Teachers Rules, 2023". It is further submitted that subsequently the State Government amended the Bihar School Exclusive Teachers Rules, 2023 by Gazette Notification dated 19.12.2024 (hereinafter for brevity, referred to as "Amendment Rules of 2024"), which amendment has been brought on record as Annexure-P/11.

Learned counsel contends that by the said "Amendment Rules of 2024", Rule-4 and Rule-10 of "Unamended Exclusive Teachers Rules, 2023" stood substituted and the provision relating to district choice was deleted and it provided for posting of "Exclusive Teachers" in their preposted schools.

46/112 not contain any provision conferring retrospective operation of the amended Rules 4 & 10 nor any clause nullifying actions already completed under the "Unamended Exclusive Teachers Rules, 2023".

10. Learned counsel further submits that since the competency test, district allotment, counselling, verification and issuance of provisional appointment letters had already been completed under the "Unamended Exclusive Teachers Rules, 2023", the "Amendment Rules of 2024" could not legally be applied to the cases of the petitioners. It is, therefore, contended that the petitioners had acquired substantive and vested rights under the "Unamended Exclusive Teachers Rules, 2023" and such rights could not be taken away retrospectively in absence of any express provision to that effect.

It is further submitted that while only allotment of schools remained to be completed, the Director, Primary Education, Government of Bihar issued Memo No.2036 dated 21.12.2024 cancelling the provisional appointment letters issued in favour of the petitioners and the likes directing all such teachers to rejoin the schools where they had earlier been working. The said Memo has been brought on record as Annexure-P/12, which is under challenge.

11. Learned counsel submits that thereafter fresh provisional appointment letters (Annexure-P/13 Series) were issued by wrongly applying the "Amendment Rules of 2024" instead of permitting the petitioners to join in their allotted districts as determined under the "Unamended Exclusive Teachers Rules, 2023". It is contended that the petitioners were thereafter compelled to join their earlier places of posting as they had no option except to comply in order to protect their services. One such joining letter issued in favour of petitioner no.1 has been brought on record as Annexure-P/14. The provisional appointment letters subsequently issued applying the "Amendment Rules of 2024" have also been challenged.

12. Learned counsel for the petitioners further submits that the action of the respondent authorities in cancelling the provisional appointment letters issued under the "Unamended Exclusive Teachers Rules, 2023" and in forcing the petitioners to rejoin their earlier schools is wholly arbitrary, discriminatory and violative of Articles 14 and 16 of the Constitution of India. It is contended that the respondents were duty bound to complete the process initiated under Rule-4 of the "Unamended Exclusive Teachers Rules, 2023" by allotting schools in the districts already

48/112 allotted to the petitioners on the basis of merit and district preference.

It is further submitted that once the recruitment process commenced under a particular statutory framework and had proceeded to the stage of issuance of provisional appointment letters, the respondents could not alter the rules of the game midway by applying the "Unamended Exclusive Teachers Rules, 2023" retrospectively. The advertisement, the guidelines and the statutory Rules together created enforceable rights and legitimate expectations in favour of the petitioners.

13. Learned counsel also submits that it is a settled principle of law that every statute or statutory rule is prospective unless expressly or by necessary implication made retrospective. According to learned counsel the "Amendment Rules of 2024" did not disclose any intention to retrospectively invalidate or reopen processes already concluded under the "Unamended Exclusive Teachers Rules, 2023". It is further submitted that similarly situated petitioners, namely petitioner nos.5, 12, 18, 22, 25, 31, 32, 33, 40, 48, 64, 67, 68, 70, 81, 86 and 88, despite having qualified in the competency test under the same advertisement and under the same statutory regime, were not even issued provisional appointment letters under the "Unamended Exclusive Teachers

49/112 Rules, 2023", which action is also stated to be arbitrary and discriminatory. It is however informed by the learned counsel for the petitioners that during the pendency of the writ application the petitioner nos.5, 12, 18, 22, 25, 31, 32, 33, 40, 48, 64, 67, 68, 70, 81, 86 and 88 were directly issued provisional appointment letters applying the "Amendment Rules of 2024" and thereby posting them at the place they were earlier working, which they had no choice but to comply under the afore-enumerated compelling circumstances.

14. Per Contra, learned counsel for the respondent no.2 (State) submits that the present writ petition has been filed questioning the legality and validity of the order contained in Memo No.2036 dated 21.12.2024 issued by the Director, Primary Education, Bihar, whereby the provisional appointment letters earlier issued in favour of the petitioners were cancelled and consequential directions were issued to the concerned District Education Officers for permitting the petitioners and other similarly situated teachers to continue at the schools where they were originally posted.

It is submitted on behalf of the respondent no.2 (State) that the impugned order dated 21.12.2024 has been issued in exercise of powers flowing from the "Unamended Exclusive

50/112 Teachers Rules, 2023" as amended by the "Amendment Rules of 2024" notified vide Notification No.3054 dated 19.12.2024.

15. Learned counsel submits that under Rule 2(vii) of the "Unamended Exclusive Teachers Rules, 2023", an "Exclusive Teacher" has been defined to mean a serving local bodies teacher who has qualified the prescribed competency test. It is contended that after amendment of the said Rules on 19.12.2024, a revised statutory mechanism was introduced regarding issuance of appointment letters and posting of teachers who had qualified the competency test.

It is further submitted that pursuant to the "Amendment Rules of 2024", the Director, Primary Education, Bihar issued the impugned order dated 21.12.2024 for implementation of the said Rules. Under the said order, all District Education Officers were directed to issue provisional appointment letters to eligible teachers from 23.12.2024 onwards through a standardized software-based system. It was further clarified therein that all earlier provisional appointment letters issued by the District Education Officers would stand cancelled.

16. Learned counsel for the respondent no.2 further submits that under the impugned order all such teachers were directed to be posted in the same schools where they had earlier

51/112 been working and formal posting orders were to be issued accordingly. It is contended that after joining pursuant to the said posting orders, the teachers concerned would discharge duties as "Exclusive Teachers" in the allotted schools and from the date of joining as "Exclusive Teachers", they would automatically stand relieved from their earlier status as local bodies teachers.

17. Learned counsel further submits that the reasons behind issuance of the impugned order dated 21.12.2024 were administrative as well as statutory in nature. It was also orally argued that the "Amendment Rules of 2024" had to be brought because most of the teachers who were posted in their home district did not want to be displaced (however this fact is not borne out from the affidavit filed by the respondent no.2). It is, therefore, submitted that after notification of the "Amendment Rules of 2024" vide Notification No.3054 dated 19.12.2024, the Director was fully empowered to issue implementation guidelines in terms of the said amended Rules. It is contended that the impugned order was issued with the object of streamlining the process of issuance of appointment letters through a uniform software-based mechanism so as to avoid administrative confusion, inconsistencies and legal irregularities arising out of provisional

52/112 appointment letters issued earlier by different District Education Officers.

18. Learned counsel also submits that the impugned directions were issued keeping in view the larger public interest and with the intention of ensuring continuity in the educational system so that teaching activities in Government Schools are not adversely affected. It is submitted that if all such teachers were immediately shifted from their existing schools, it would have resulted in serious administrative dislocation and disruption in the functioning of educational institutions. Accordingly, the teachers were directed to continue in the schools where they were already working and complete their joining between 01.01.2025 and 07.01.2025.

It is thus submitted that the impugned order merely operationalizes and implements the amended statutory Rules by providing a standardized procedure for issuance of fresh appointment letters and posting orders. Learned counsel submits that the earlier provisional appointment letters were superseded only in order to give effect to the "Amendment Rules of 2024" and not with any malafide intention or arbitrariness.

19. Learned counsel for the respondent no.2 further submits that the "Unamended Exclusive Teachers Rules, 2023"

53/112 themselves contemplate change in service conditions of teachers who qualify the competency test and no vested or indefeasible right accrued in favour of the petitioners merely on the basis of provisional appointment letters. According to learned counsel, no fundamental or legal right of the petitioners has been infringed by the impugned order and, on the contrary, the implementation of the "Amendment Rules of 2024" is intended to confer benefit upon successful candidates by integrating them into the State teaching cadre. It is, therefore, contended that the petitioners cannot claim a right contrary to the statutory framework and cannot seek to disregard the "Amendment Rules of 2024" merely because they are dissatisfied with the policy decision of the State Government.

20. Learned counsel submits that apart from expressing disagreement with the administrative decision reflected in the impugned order, the petitioners have failed to point out any illegality or procedural irregularity. It is further submitted that the impugned order is merely an administrative guideline issued for implementation of validly framed statutory Rules and does not create any new disability or adverse civil consequence warranting interference in exercise of writ jurisdiction. It is contended that the impugned order is not a quasi-judicial determination affecting any accrued legal right of the petitioners and, therefore, the scope of

54/112 judicial review in the present matter is extremely limited. Learned counsel submits that in absence of any demonstrable violation of statutory provisions or constitutional mandate, no case for interference is made out.

21. Learned counsel further submits that the challenge made by the petitioners proceeds on an erroneous assumption that the Department acted beyond its authority while issuing the impugned order, whereas in fact the same was issued strictly under the authority conferred by the "Amendment Rules of 2024". It is submitted that the Rules were duly notified and the Director, Primary Education was fully competent to issue implementation instructions pursuant thereto. It is further submitted that the petition itself is premature and misconceived inasmuch as the petitioners continue to remain in service and their appointment as "Exclusive Teachers" is being processed in accordance with law and under the amended statutory scheme.

22. Learned counsel for the respondent no.2 submits that the impugned order has been issued to faithfully enforce the "Unamended Exclusive Teachers Rules, 2023" as amended vide Notification No.3054 dated 19.12.2024. The Rules contemplate appointment and posting of teachers qualifying the competency test as "Exclusive Teachers" and the Department was fully

55/112 competent to streamline and coordinate the process of appointment and posting in administrative interest. It is further submitted that the direction requiring the petitioners and similarly situated teachers to continue in the schools where they were already posted is fully consistent with the object and scheme of the "Amendment Rules of 2024". According to learned counsel, such posting ensures continuity in education and prevents disruption in academic activities. It is contended that continuation in the existing schools cannot be treated as a grievance, rather the same is beneficial from an administrative as well as academic standpoint.

23. Learned counsel also submits that the "Unamended Exclusive Teachers Rules, 2023" as amended contemplate a phased transition from local bodies teachers to Exclusive Teachers and do not confer immediate permanent status upon qualifying the competency test. The provisional appointment letters followed by formal joining and confirmation form part of the statutory transition process envisaged under the "Amendment Rules of 2024".

It is further submitted that the provisional appointment letters subsequently issued by the District Education Officers pursuant to the amended procedure were generated through the

56/112 authorized software system and were duly authenticated. Learned counsel submits that replacement of earlier provisional appointment letters with software-generated letters does not prejudice the petitioners in any manner and merely ensures procedural uniformity and administrative regularity. In conclusion, learned counsel for the respondent no.2 submits that the answering respondents have acted strictly within the four corners of the statutory framework and the impugned order dated 21.12.2024 faithfully implements the "Unamended Exclusive Teachers Rules, 2023" as amended in 2024. It is contended that there is no illegality, arbitrariness or violation of constitutional or statutory provisions in the action of the respondents. It is thus submitted that the writ petition being devoid of merit is fit to be dismissed.

24. Learned counsel for the respondent Bihar School Examination Board (B.S.E.B.) states that all the petitioners are admittedly Local Bodies Teachers appointed under the provisions of the Bihar Panchayat Primary Teachers (Appointment and Service Conditions) Rules, 2012. It is submitted that subsequently the State Government framed the "Unamended Exclusive Teachers Rules, 2023" with the object of bringing teachers employed by the Local Bodies at par with teachers appointed under the Bihar

57/112 School Teachers (Appointment, Transfer, Disciplinary Proceeding and Service Condition) Rules, 2023.

Learned counsel further submits that under Rule 3 read with Rule 4 of the "Unamended Exclusive Teachers Rules, 2023", all Local Bodies Teachers were required to qualify the competency test and upon qualifying the same, they were to be brought under a single district cadre as "Exclusive Teachers" from the date of joining in the allotted schools. It is further submitted that thereafter the State Government amended the Bihar School Exclusive Teachers Rules, 2023 by way of the "Amendment Rules of 2024" notified on 19.12.2024 and pursuant thereto all the teachers including the petitioners, except some of them, were directed to join in the schools where they were already working after cancellation of their earlier provisional appointment letters. Learned counsel submits that the principal grievance of the petitioners pertains to the issue of appointment and posting under the "Amendment Rules of 2024".

25. Learned counsel submits that by Notification contained in Memo No.11 dated 15.01.2024, the Bihar School Examination Board was authorized by the State Government to conduct the Competency Test, 2024 (CTT-2024) in terms of Rule 4 and Rule-13 of the "Unamended Exclusive Teachers Rules, 2023".

58/112 A copy of the said Notification has been brought on record as Annexure-R/A.

Learned counsel further submits that pursuant to the aforesaid authorization, the answering respondent Board issued advertisement dated 25.01.2024 for conducting the Competency Test, 2024 (CTT-2024). It is submitted that the petitioners appeared in the said examination and were declared successful and thereafter became eligible for posting as "Exclusive Teachers" in the allotted schools in accordance with the applicable Rules.

26. Learned counsel for the respondent B.S.E.B. specifically submits that the Board has no role whatsoever in the matter of appointment, posting or issuance of appointment letters. According to learned counsel, the role of the Board is confined only to conducting the competency examination under the instructions issued by the Education Department and verification of certificates/documents of the candidates. It is further submitted that matters relating to appointment and posting are to be governed strictly in accordance with the "Unamended Exclusive Teachers Rules, 2023" and the amended provisions thereof and such matters do not fall within the ambit, authority or jurisdiction of the answering respondent Board.

ISSUES FOR CONSIDERATION:

1. Whether the respondent authorities were legally justified in applying the "Amendment Rules of 2024" retrospectively to the cases of the petitioners, despite the competency test, district allotment, counselling, document verification and issuance of provisional appointment letters having already been completed under the "Unamended Exclusive Teachers Rules, 2023"?

3. Whether the petitioners, after qualifying the competency test and being allotted districts and issued provisional appointment letters under the "Unamended Exclusive Teachers Rules, 2023", had acquired a vested right and/or legitimate expectation to be posted in the allotted districts in accordance with the unamended statutory rules, which could not be defeated by subsequent executive action or amendment in the Rules?

60/112 FINDINGS:

Findings on Issue no. (1) So far as Issue No.1 is concerned, namely, whether the respondent authorities were legally justified in applying the "Amendment Rules of 2024" retrospectively to the cases of the petitioners despite the competency test, district allotment, counselling, document verification and issuance of provisional appointment letters having already been completed under the unamended "Unamended Exclusive Teachers Rules, 2023", this Court proceeds to examine the statutory scheme, the sequence of events and the rival submissions advanced on behalf of the parties. From the materials available on record, it appears that the petitioners were initially appointed as Local Bodies Teachers under the prevailing statutory framework governing Panchayat/Local Bodies Teachers. Subsequently, the State

61/112 Government framed the "Unamended Exclusive Teachers Rules, 2023" with the object of bringing Local Bodies Teachers at par with teachers appointed under the Bihar School Teachers (Appointment, Transfer, Disciplinary Proceeding and Service Condition) Rules, 2023.

Under the scheme of the "Unamended Exclusive Teachers Rules, 2023", particularly Rule 3 read with Rule 4 thereof, all Local Bodies Teachers were required to qualify a competency test conducted through an authorized Government agency and upon qualifying the same and joining in the allotted schools, such teachers were to be treated as "Exclusive Teachers". The Rules further contemplated that at the time of submission of the application form for the competency test, candidates were required to furnish preferences of districts where they intended to serve and district allotment was to be made on the basis of merit obtained in the competency test. Relevant portion of Rule 3 and Rule 4 of the "Unamended Exclusive Teachers Rules, 2023" are quoted here for reference:

"Rule-3 Constitution of Cadre:- (1) All the teachers employed by the various tiers of local bodies (viz. Panchayati Raj and Urban Bodies) shall be required to pass a competency test under Rule 4 and upon passing the test and joining the allotted

62/112 school thereafter be called "Exclusive Teachers". The Local Bodies Teachers employed at various. ties of local bodies shall stand merged as a single cadre at the district level from the date of joining the allotted school as per the allotted district in the competency test. They shall constitute a separate cadre whose service conditions shall henceforth be regulated by these Rules. Provided that these Exclusive Teachers upon passing the competency test under Rule 4 will be entitled to avail the salary and other perks appointed under Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023. Provided further that any disciplinary action, vigilance enquiry or any other Pestigation pending against such"Local Bodies" Teachers who become "Exclusive Teachers", shall continue as per the provisions of these new Rules.

(2) As and when an Exclusive Teacher retires or resigns or is dismissed, the resulting Vacancy shall not be filled by local bodies. The Department shall be competent to retain a certain percentage of such vacancies for promotion of these Exclusive Teachers and transfer the remaining to the cadre of School Teachers appointed under Bihar State School Teachers (Appointment, Transfer, Disciplinary Proceedings and Service Conditions) Rules, 2023.

(3) Those "local bodies" teachers who do not appear in or pass the Competency Test as per Rule 4, shall continue to remain "Local Bodies" Teachers.

Rule-4- Competency Test:- The Department, through a government agency of its choice shall conduct a competency test for all serving Local Bodies Teachers. The competency test shall be conducted over a period of one year from the date of promulgation of these Rules. Three attempts to pass the competency test shall be given to each local bodies teacher. At the time of appearing in the test, the local bodies teacher shall be required to give three choices of the districts they wish to serve as Exclusive Teachers. Districts shall be allotted based on their rank in the competency test. Provided that cases of all those local bodies teachers who do not appear or fail to clear the competency test in the 3rd attempt shall be considered separately by the Department.

The Department shall constitute a committee to consider the cases of all such local bodies teachers and make suitable recommendation to the Government and to that extent, the "Local Bodies Teachers Rules, 2020" shall stand modified." Further, the guidelines issued by the State Government vide Memo dated 23.01.2024 as well as the advertisement issued by the Bihar School Examination Board on 25.01.

64/112 reiterated the aforesaid statutory position and specifically provided that candidates would furnish district preferences and districts would be allotted accordingly. Relevant paragraph of the guideline vide Memo No.139 dated 23.01.2024 providing the details regarding conducting of competency test are reproduced herein for ready reference.

[Emphasis supplied] It is not in dispute that pursuant to the aforesaid Rules and guidelines, all the petitioners submitted their applications, furnished district preferences, appeared in the competency test conducted in February, 2024 and were declared successful. The result cards issued by the Bihar School Examination Board itself

65/112 reflected the districts allotted to the petitioners as per the district preferences given by them.

Thereafter, the petitioners were called for counselling and document verification and the records disclose that their credentials were duly verified by the concerned authorities. Subsequently, provisional appointment letters dated 20.11.2024 came to be issued in favour of the petitioners by the respective District Education Officers of the allotted districts. A perusal of the said provisional appointment letters demonstrates that the appointments had been made in accordance with the "Unamended Exclusive Teachers Rules, 2023" and the allotment of districts had been made on the basis of merit and preference under the statutory framework then prevailing. The relevant portion of the provisional appointment letter dated 20.11.2024 is quoted herein below for ready reference.

The principal contention advanced on behalf of the petitioners is that after completion of the aforesaid stages, a substantive and accrued right came into existence in their favour to be considered for posting in the allotted districts under the unamended Rules and such right could not subsequently be taken away by retrospective application of the "Amendment Rules of 2024".

67/112 reopen or nullify a process already completed under the earlier statutory regime.

On the other hand, learned counsel appearing on behalf of the respondent authorities has contended that the impugned order dated 21.12.2024 merely operationalizes the "Amendment Rules of 2024" and that the State Government was competent to issue fresh implementation guidelines in administrative interest. It has also been contended that the petitioners had not acquired any indefeasible right merely on the basis of provisional appointment letters and that the "Amendment Rules of 2024" contemplated a phased transition of Local Bodies Teachers into the cadre of "Exclusive Teachers".

Having considered the rival submissions and materials on record, this Court finds that the controversy essentially turns upon the nature and effect of the "Amendment Rules of 2024" and whether the same were intended to apply retrospectively to processes already completed under the "Unamended Exclusive Teachers Rules, 2023".

At this stage, it would be apposite to notice the settled principle of statutory interpretation that every statute or statutory rule is presumed to operate prospectively unless the legislature expressly or by necessary implication gives retrospective effect to

68/112 the same. The reason behind such principle is that accrued or vested rights cannot ordinarily be divested by subsequent amendments unless the statutory language clearly compels such a consequence.

The "Amendment Rules of 2024" admittedly came into force on 19.12.2024. However, from a plain reading of the amendment notification and the substituted provisions, this Court does not find any express stipulation giving retrospective effect to the amendment. Equally, no provision has been brought to the notice of this Court indicating that the State intended to reopen, cancel or nullify actions already completed under the "Unamended Exclusive Teachers Rules, 2023".

Significantly, the respondents themselves have admitted in their counter affidavit that the provisional appointment letters issued earlier were cancelled after implementation of the "Amendment Rules of 2024" and fresh directions were issued requiring the petitioners to continue in their existing schools. Therefore, the action of the respondents clearly amounts to giving retrospective operational effect to the amended provisions in respect of a process which had already substantially concluded under the earlier Rules.

69/112 This Court is unable to accept the contention of the respondents that the impugned order is merely an administrative guideline having no bearing upon accrued rights of the petitioners. The effect of the impugned action is not merely procedural. By cancellation of the provisional appointment letters and by directing the petitioners to continue in their previous schools, the respondents effectively nullified the district allotments made under the "Unamended Exclusive Teachers Rules, 2023" and deprived the petitioners of the benefit flowing from the earlier statutory scheme. At this juncture, it is equally relevant to note that the petitioners were not merely aspirants participating in an ongoing process.

Their competency test had concluded, districts had already been allotted on merit, counselling and verification had been completed and provisional appointment letters had also been issued. Therefore, the selection process had crossed the stage of mere expectation and had ripened into a crystallized entitlement under the "Unamended Exclusive Teachers Rules, 2023", subject of course to completion of consequential formalities. The submission of the respondents that the petitioners had acquired no vested right merely because the appointment letters were provisional also cannot be accepted in the facts of the present case.

70/112 acquire an indefeasible right to appointment merely by participation in a selection process, the position stands materially altered where the entire process has been completed under a particular statutory framework and the State thereafter seeks to alter essential conditions of appointment by subsequent amendment without express/implied retrospective operation. In the present case, district preference and allotment formed an integral and substantive component of the recruitment process under the "Unamended Exclusive Teachers Rules, 2023". The respondents, after acting upon the said Rules throughout the process, could not subsequently apply the amended provisions to deprive the petitioners of the benefits already accrued in their favour. The Court is also of the considered opinion that administrative convenience or policy considerations, howsoever important, cannot by themselves authorize retrospective application of statutory amendments in absence of express/implied legislative sanction.

Accordingly, this Court holds that the respondent authorities were not legally justified in retrospectively applying the "Amendment Rules of 2024" to the cases of the petitioners after completion of the competency test, district allotment, counselling, document verification and issuance of provisional appointment

71/112 letters under the unamended "Bihar School Exclusive Teachers Rules, 2023". The action of the respondents in cancelling the earlier provisional appointment letters and in altering the district allotment already made under the unamended Rules is therefore unsustainable in law.

2. Whether the cancellation of the provisional appointment letters dated 20.11.2024 issued in favour of the petitioners and the consequential direction compelling them to continue in their earlier schools vide Memo No.2036 dated 21.12.2024 are arbitrary, violative of Articles 14 and 16 of the Constitution of India and contrary to the doctrine that the "rules of the game" cannot be changed after commencement and substantial completion of the selection process? Findings on Issue no. (2) So far as Issue No.2 is concerned, namely, whether the cancellation of the provisional appointment letters dated 20.11.2024 issued in favour of the petitioners and the consequential direction compelling them to continue in their earlier schools vide Memo No.2036 dated 21.12.2024 are arbitrary, violative of Articles 14 and 16 of the Constitution of India and contrary to the settled principle that the "rules of the game" cannot be changed after commencement and substantial completion of the selection

72/112 process, this Court proceeds to examine the legality and effect of the impugned action in the backdrop of the admitted factual matrix. From the records of the case, it emerges that the petitioners participated in the process initiated under the "Unamended Exclusive Teachers Rules, 2023" and the guidelines issued thereunder. Under the statutory framework prevailing at the relevant point of time, Local Bodies Teachers were required to appear in a competency test and while applying for the said examination, they were required to furnish preferences of districts where they intended to serve as "Exclusive Teachers". The materials on record further disclose that the petitioners participated in the competency test conducted by the Bihar School Examination Board pursuant to the notification and advertisement issued for such purpose. It is not disputed by the respondents that all the petitioners were declared successful in the competency test and that districts were allotted to most of them on the basis of merit and district preference.

It further appears from the records that after declaration of result, the petitioners were called for counselling and verification of documents by the concerned District Education Officers. The documents submitted by the petitioners were duly verified and the authorities thereafter proceeded to issue

73/112 provisional appointment letters dated 20.11.2024 in favour of most of the petitioners.

A perusal of the said provisional appointment letters demonstrates that the appointments were made in accordance with the "Unamended Exclusive Teachers Rules, 2023" and the petitioners were to be posted in the districts allotted to them pursuant to the competency test process. However, before the petitioners could be finally allotted schools within the allotted districts, the respondent authorities issued Memo No.2036 dated 21.12.2024 cancelling the earlier provisional appointment letters and directing the petitioners to continue in the same schools where they had previously been working as Local Bodies Teachers. The principal grievance of the petitioners is that the impugned action completely altered the basis of the recruitment process after the process had substantially concluded and thereby deprived the petitioners of the benefit of district allotment secured by them on the basis of merit under the "Unamended Exclusive Teachers Rules, 2023".

On the other hand, the respondents have sought to justify the impugned action by contending that the "Amendment Rules of 2024" contemplated a revised mechanism for appointment and posting and that the impugned order was issued to streamline

74/112 the process, avoid administrative confusion and ensure continuity in educational activities. The respondents have further contended that the petitioners had no indefeasible right to insist upon posting in the allotted districts merely on the basis of provisional appointment letters.

Having considered the rival submissions, this Court finds that the impugned action cannot be viewed as a mere procedural adjustment or administrative arrangement. The consequence of cancellation of the provisional appointment letters was that the petitioners were deprived of the districts allotted to them under the unamended statutory framework and were compelled to continue in their earlier places of posting despite successfully participating in a process which specifically contemplated district preference and district allotment. The Court is of the considered opinion that district allotment was not an incidental or insignificant aspect of the recruitment process. Rather, it constituted a substantive component of the selection mechanism itself. The petitioners were required to exercise district preferences at the time of application, districts were allotted on the basis of merit and such allotment formed part of the result declared by the Bihar School Examination Board.

75/112 Therefore, once the respondents permitted the entire process to proceed under the "Unamended Exclusive Teachers Rules, 2023", conducted the competency test, allotted districts, completed counselling and verification and thereafter issued provisional appointment letters, the authorities could not subsequently alter the essential terms of the process to the prejudice of the petitioners.

At this stage, the principle that the "rules of the game" cannot be changed after commencement of the selection process assumes considerable significance. The said doctrine has consistently been recognized by the constitutional courts to ensure fairness, transparency and non-arbitrariness in public recruitment. Once a recruitment process is initiated under a particular statutory or procedural framework, candidates who participate in the process acquire a legitimate expectation that the selection shall be completed in accordance with the same rules unless the governing statute itself expressly/impliedly provides otherwise. In the present case, the petitioners participated in the process on the clear understanding, flowing from the Rules, guidelines and advertisement, that district allotment would be made on the basis of merit and preference. The respondents themselves acted upon the said framework throughout the process and only

76/112 after completion of all material stages sought to alter the position by cancelling the provisional appointment letters. The Court finds considerable force in the submission advanced on behalf of the petitioners that the respondents effectively changed the conditions governing appointment after substantial completion of the process. Such action strikes at the root of fairness in public employment and cannot withstand scrutiny under Articles 14 and 16 of the Constitution of India. Article 14 mandates fairness and non-arbitrariness in State action, while Article 16 guarantees equality of opportunity in matters relating to public employment. Any action of the State which is arbitrary, unreasonable or discriminatory in the matter of recruitment and appointment would fall foul of the constitutional mandate.

In the present case, the impugned action not only altered the basis of appointment after completion of the process but also deprived the petitioners of the benefit earned by them through merit in the competency test. The petitioners had participated in the process with a legitimate expectation that district allotment would be honoured in terms of the governing Rules and guidelines. The sudden cancellation of the earlier appointment letters and direction

77/112 to continue in the previous schools defeated the very basis on which the petitioners had participated in the process. The justification sought to be offered by the respondents on grounds of administrative convenience and continuity of education also does not persuade this Court to uphold the impugned action. Administrative convenience, though relevant, cannot override statutory provisions nor can it justify alteration of the conditions of selection after completion of the process. Once the respondents themselves adopted a merit-based district allotment mechanism under the "Unamended Exclusive Teachers Rules, 2023", they were bound to carry the process to its logical conclusion.

This Court also cannot lose sight of the fact that the respondents themselves admitted in the counter affidavit that the provisional appointment letters issued earlier stood cancelled after implementation of the "Amendment Rules of 2024". Thus, the cancellation was not on account of any defect attributable to the petitioners, suppression of facts or irregularity in the selection process, but solely because the State subsequently decided to alter the mechanism of posting.

The Court is, therefore, of the considered view that the cancellation of the provisional appointment letters dated

78/112 20.11.2024 and the consequential direction compelling the petitioners to continue in their earlier schools vide Memo No.2036 dated 21.12.2024 were arbitrary and unsustainable in law. The impugned action amounts to changing the rules governing appointment after commencement and substantial completion of the selection process and thereby violates the constitutional guarantees contained under Articles 14 and 16 of the Constitution of India.

3. Whether the petitioners, after qualifying the competency test and being allotted districts and issued provisional appointment letters under the Unamended Exclusive Teachers Rules, 2023, had acquired a vested right and/or legitimate expectation to be posted in the allotted districts in accordance with the unamended statutory rules, which could not be defeated by subsequent executive action or amendment in the Rules?

Findings on Issue no. (3) So far as Issue No.3 is concerned, namely, whether the petitioners, after qualifying the competency test and being allotted districts and some of them also being issued provisional appointment letters under the "Unamended Exclusive Teachers Rules, 2023", had acquired a vested right and/or legitimate

79/112 expectation to be posted in the allotted districts in accordance with the unamended statutory scheme, which could not be defeated by subsequent executive action or amendment in the Rules, this Court proceeds to examine the nature of the rights claimed by the petitioners in the light of the statutory framework and the admitted facts on record.

At the outset, it is necessary to notice that the petitioners participated in the competency test process initiated under the "Unamended Exclusive Teachers Rules, 2023" and the guidelines issued thereunder. The statutory scheme prevailing at the relevant point of time specifically contemplated that Local Bodies Teachers, upon qualifying the competency test, would be allotted districts on the basis of merit and preference and thereafter be posted as "Exclusive Teachers" in the allotted districts. The records further reveal that while submitting their applications for the competency test, all the petitioners exercised district preferences in terms of Rule 4 of the unamended Rules and the guidelines issued by the State Government. It is not disputed by the respondents that all the petitioners appeared in the competency test conducted by the Bihar School Examination Board and were declared successful. It also appears from the result cards issued by the Bihar School Examination Board that districts were allotted to

80/112 the petitioners on the basis of merit and preference under the prevailing Rules.

Thereafter, the petitioners were called for counselling and verification of documents and the authorities concerned verified their credentials in accordance with the prescribed procedure. The materials on record further disclose that provisional appointment letters dated 20.11.2024 were issued in favour of several petitioners by the respective District Education Officers of the allotted districts. However, the writ petition itself specifically records that some petitioners, namely petitioner nos. 5, 12, 18, 22, 25, 31, 32, 33, 40, 48, 64, 67, 68, 70, 81, 86 and 88, were not issued provisional appointment letters though they had also qualified the competency test and had been allotted districts in the same process.

Thus, factually, the petitioners fall into two categories: firstly, those who had been issued provisional appointment letters dated 20.11.2024 and secondly, those who, despite successful completion of all stages of the process, including the allotment of districts as per their preferences, had not been issued such provisional appointment letters. The question, therefore, is whether both categories of petitioners can claim protection on the basis of vested right and/or legitimate expectation under the "Unamended

81/112 Exclusive Teachers Rules, 2023". Learned counsel for the petitioners have also relied on Abhay Kumar Patel & Ors. v. State of Bihar & Ors. reported in 2026 SCC OnLine SC 20, relevant paragraph of which are quoted herein for reference: "37. The distinction drawn by the respondents regarding the "provisional" nature of the merit list is untenable. The list was provisional subject to verification of documents, not subject to a fundamental change in the criteria for placement in the merit list itself. Once a candidate has cleared the written examination and found a place in the merit list based on the announced criteria in line with the extant Rules and the advertisement, a legitimate expectation arises that the selection will be finalized based on the criteria which was advertised at the time of initiation of the recruitment process.

38. The retrospective application of Rule 8(5) creates an anomaly where candidates who competed under one set of rules are now being judged by another, ex post facto. This directly impacts the appellants, who may be pushed down the merit list or ousted entirely by candidates who score lower in the written exam but gain the newly introduced additional marks for contractual service.

39. We also note the argument regarding the General Administration Department's 2018 Memo and 2021 Memo. While these resolutions reflect a policy to grant weightage, they were executive instructions. The recruitment in question was governed by the statutory 2019 Rules, which did not incorporate these resolutions at the time of the 2019 Advertisements. The State cannot rely on executive instructions to override statutory

82/112 rules that were in force during the initiation of the recruitment process, especially to the detriment of candidates who had no notice of such weightage or age relaxation.

Additionally, when the 2019 Advertisements were issued, there was no whisper about the applicability of the said resolutions; it was only when a challenge was made by the candidates that the State raised the defense, taking a pretext of the aforesaid resolutions, which is an afterthought and not tenable at all."

[Emphasis supplied] So far as the petitioners who had already been issued provisional appointment letters are concerned, this Court is of the considered opinion that their claim stands on a much stronger footing. The issuance of provisional appointment letters after completion of the competency test, district allotment, counselling and document verification clearly demonstrates that the authorities had accepted and acted upon the selection process conducted under the "Unamended Exclusive Teachers Rules, 2023". The provisional appointment letters themselves recorded that the appointments had been made under the "Unamended Exclusive Teachers Rules, 2023" and that district allotment had been made on the basis of merit and preference. Therefore, in respect of such petitioners, the process had clearly advanced beyond the stage of a mere expectation or hope of appointment. The State authorities had

83/112 already recognized their entitlement under the unamended statutory framework and had taken concrete steps towards giving effect to the same.

At the same time, this Court is also of the opinion that even those petitioners who had not been issued provisional appointment letters under the "Unamended Exclusive Teachers Rules, 2023" cannot be treated as mere aspirants having no enforceable claim whatsoever. Admittedly, such petitioners had also participated in the same recruitment process, qualified the competency test, obtained district allotment and completed counselling and document verification under the "Unamended Exclusive Teachers Rules, 2023".

The respondents have not disputed that all the petitioners formed part of the same selection process initiated under the "Unamended Exclusive Teachers Rules, 2023". The distinction that some of the petitioners had not been issued provisional appointment letters appears to be merely procedural and administrative in nature and not attributable to any deficiency or disqualification on their part or based on any intelligible differentia.

In such circumstances, this Court is of the considered view that all the petitioners had acquired, at the very least, a legitimate

84/112 expectation that the process initiated under the "Unamended Exclusive Teachers Rules, 2023" would be carried to its logical conclusion in accordance with the same statutory framework. In the present case, the State itself framed the "Unamended Exclusive Teachers Rules, 2023", invited applications under the said Rules, required candidates to furnish district preferences, conducted the competency test, allotted districts on merit, completed counselling and verification and in many cases even issued provisional appointment letters. Thus, the entire conduct of the respondents unmistakably represented that appointments and postings would be finalized in terms of the "Unamended Exclusive Teachers Rules, 2023".

Consequently, the petitioners legitimately expected that they would be posted in the allotted districts in accordance with the statutory scheme under which the process had been initiated and substantially completed.

The Court is also of the opinion that in the case of those petitioners who had already received provisional appointment letters, the right accrued in their favour cannot be brushed aside as a mere abstract expectation. Although a provisional appointment may not always confer an indefeasible right to final appointment, yet where such appointment is preceded by completion of the entire

85/112 selection process under a particular statutory framework, the State cannot arbitrarily nullify the same by subsequently altering essential conditions of appointment through executive action. The respondents have sought to contend that no vested right accrued in favour of the petitioners and that the "Amendment Rules of 2024" merely regulated the transition process of Local Bodies Teachers into the cadre of Exclusive Teachers. However, this Court finds that such submission overlooks the crucial fact that the position qua the petitioners had already stood altered on the basis of the process undertaken by the State under the "Unamended Exclusive Teachers Rules, 2023". The impugned action not only deprived the petitioners of district allotments secured on merit but also completely defeated the expectations generated by the statutory process itself.

The Court is, therefore, of the considered opinion that the respondents could not, by subsequent executive instructions or by applying the "Amendment Rules of 2024" retrospectively, defeat the accrued rights and legitimate expectations arising out of the "Unamended Exclusive Teachers Rules, 2023".

Accordingly, this issue is answered in favour of the petitioners by holding that the petitioners, after qualifying the

86/112 competency test and being allotted districts under the "Unamended Exclusive Teachers Rules, 2023", had acquired a legitimate expectation to be posted in the allotted districts in accordance with the unamended statutory scheme and, in the case of those petitioners who had already been issued provisional appointment letters, an accrued substantive right had also come into existence in their favour. Such rights and expectations could not legally be defeated by subsequent executive action or by retrospective application of the "Amendment Rules of 2024".

27. Accordingly, in view of the discussions made hereinabove and for the reasons recorded while answering the issues framed by this Court, the writ petition deserves to be allowed.Consequently, the order contained in Memo No.2036 dated 21.12.2024 (Annexure-P/12) issued by the Director, Primary Education, Bihar, Patna, whereby the provisional appointment letters issued in favour of the petitioners were cancelled and the petitioners were directed to continue in their earlier schools, is hereby quashed to the extent it applies to the present petitioners. Resultantly the subsequent provisional appointment letters (Annexure-13 Series) issued in terms of "Amendment Rules of 2024" are also quashed.

28. Further, the consequential action of the respondent authorities in giving retrospective effect to the "Amendment Rules of 2024" in respect of the petitioners, despite completion of the selection process under the "Unamended Exclusive Teachers Rules, 2023", is held to be arbitrary and unsustainable in law. The respondent authorities are accordingly directed to give effect to the selection process undertaken under the "Unamended Exclusive Teachers Rules, 2023" and to proceed with the appointments/postings of the petitioners in the districts allotted to them pursuant to the competency test conducted under the unamended statutory scheme. The earlier provisional appointment letters dated 20.11.2024 issued in favour of the petitioners shall stand restored and acted upon by the concerned authorities.

In respect of those petitioners who were not issued provisional appointment letters despite having qualified in the same process and having been allotted districts, the respondent authorities shall issue consequential appointment/posting orders in accordance with the "Unamended Exclusive Teachers Rules, 2023" after cancelling their subsequent provisional appointment letters, if any, have been issued in terms of "Amendment Rules of 2024".

29. The respondent authorities are further directed to complete the exercise of allotment of schools and consequential posting of the petitioners in their respective allotted districts within a period of six weeks from the date of receipt/production of a copy of this judgment.

30. The writ petition is, accordingly, allowed in the aforesaid terms. All pending I.As, if any, stands disposed of. However, there shall be no order as to costs. CWJC No.9912 of 2025 Heard the parties.

2. Since the petitioners of this case are similarly situated as the petitioners of CWJC No.6127 of 2025 and the facts, issues involved as well as reliefs claimed are also similar in nature, therefore, this writ application is also allowed in terms of the aforesaid judgment delivered in CWJC No.6127 of 2025.

89/112 letters issued in favour of the petitioners were cancelled and the petitioners were directed to continue in their earlier schools, is hereby quashed to the extent it applies to the present petitioners. Resultantly, the subsequent provisional appointment letters (Annexure-13 Series) issued in terms of "Amendment Rules of 2024" are also quashed.

4. Further, the consequential action of the respondent authorities in giving retrospective effect to the "Amendment Rules of 2024" in respect of the petitioners, despite completion of the selection process under the "Unamended Exclusive Teachers Rules, 2023", is held to be arbitrary and unsustainable in law. The respondent authorities are accordingly directed to give effect to the selection process undertaken under the "Unamended Exclusive Teachers Rules, 2023" and to proceed with the appointments/postings of the petitioners in the districts allotted to them pursuant to the competency test conducted under the unamended statutory scheme. Further, the consequential action of the respondent authorities in giving retrospective effect to the "Amendment Rules of 2024" in respect of the petitioner, despite completion of the selection process under the "Unamended Exclusive Teachers Rules, 2023", is held to be arbitrary and unsustainable in law. The respondent authorities are accordingly directed to give effect to the selection process undertaken under the "Unamended Exclusive Teachers Rules, 2023" and to proceed with the appointment/posting of the petitioner in the districts allotted to them pursuant to the competency test conducted under the unamended statutory scheme.
