Petitioners point out that there is an error in penultimate paragraph of the judgment dated 08.12.2016. It is stated in the order that petitioners did not challenge the order passed by the
Patna High Court MJC No.546 of 2017 dt.03-04-2017 2 / 2 learned Company Judge passed on 19.02.2010.
It is stated that in fact the petitioners preferred Company Appeal (DB) No.10 of 2010 whereas M/s. Daya Builders & Properties Private Limited, Sunita Singh and Shashank Shekhar (purchaser) preferred Company Appeal (DB) No.07 of 2010. Both the appeals were heard and were dismissed by Division Bench on 27.01.2011 and 21.05.2010 respectively.
Accordingly, the last sentence of penultimate paragraph of the order dated 08.12.2016 would now be read as under:- "It is stated that in fact the petitioners preferred Company Appeal (DB) No.10 of 2010 whereas M/s. Daya Builders & Properties Private Limited, Sunita Singh and Shashank Shekhar (purchaser) preferred Company Appeal (DB) No.07 of 2010. Both the appeals were heard and were dismissed by Division Bench on 27.01.2011 and 21.05.2010 respectively." This disposes of this application.
