JUSTICE SANJAY PRIYA ORAL ORDER 2/ 30-11-2018 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner seeks bail in Parsa Bazar P.S. Case No.19 of 2018 instituted for the offence under Section(s) 307 and other allied sections of Indian Penal Code and Section 27 of the Arms Act.
From the written report, it appears that there is allegation against Tunnu and Shailesh of causing fire arm injury to the informant, who are son of the petitioners. There is no allegation of any specific overt act against the petitioner. Counsel for the petitioner submits that Petitioner is in custody since 18.07.2018 having clean antecedents. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna, in connection with Parsa Bazar P.S. Case No.19 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
