This application is for grant of regular bail in connection with Bibhutipur P.S.case No.130 of 2017 for the offences under Sections 304(B)/34 of the Indian Penal Code. Allegation against the petitioner is of administering poison to his wife and the viscera report was called for that also shows that it contains the sulphas.

Submission of the learned counsel for the petitioner is that she has herself took poison as there was some altercation between the parties. Petitioner is in custody since 7.1.2019.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant

Patna High Court CR. MISC. No.48890 of 2019(6) dt.02-03-2020 2/2 bail to the petitioner , however, the learned trial court is directed to expedite the trial and once the informant and his family members are examined or after six months, the petitioner is at liberty to renew his prayer for bail before the learned trial court . Accordingly, this application is dismissed.
