This application for anticipatory bail arises out of Ujjarpur P.S. Case No. 291 of 2018, disclosing offences under Sections 323, 324, 325, 341, 379, 307, 435, 447, 504 and 506/34 of the Indian Penal Code.
There is allegation against all the named accused persons of having assaulted the informant and his family members. It is alleged against the petitioner that he assaulted one Ajay Jha with a farsa.
Learned counsel, appearing on behalf of the petitioner, states that the injury has been found to be simple in nature and it is because of local dispute that the criminal case has been filed, much after an FIR in Ujjarpur P.S. Case No. 277
Patna High Court CR. MISC. No.50521 of 2019(2) dt.14-08-2019 2/2 of 2018 was filed by the petitioner's brother, implicating the informant as an accused.
Considering the facts and circumstances of the case, this application is allowed. Let the petitioner, above named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned S.D.J.M., Dalsingsarai in connection with Ujjarpur P.S. Case No. 291 of 2018, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
