ANJANA MISHRA ORAL ORDER 03-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Banshi P.S.Case No.29/15 for the offences under Sections 420, 467, 468 and 471 of the I.P.C.
Case diary of this case which was called for has since been received.
Learned counsel for the petitioner submits that the present case has been instituted by the District Programme Officer, Arwal, against the present petitioner who was Incharge Headmaster of the School.
Allegation against the petitioner is that he has
Patna High Court Cr.Misc. No.34472 of 2015 (3) dt.03-12-2015 2/3 committed irregularities in distribution of cycle and uniform scheme to the students of the school who had less than 75% attendance in the school and had also taken Rs.300/- each for releasing the said benefit/ funds in their favour as a result of which the petitioner is said to have committed fraud of Rs.79,500/- in the scheme of cycle and Rs.2,12,000/- by way of showing release of dress money to the students.
Learned counsel for the petitioner submits that the entire allegation is false and frivolous and the money had been distributed in a proper manner to the students who have also denied the said allegation and spoken in favour of the petitioner. Learned counsel for the State after perusal of the case diary submits that apart from the allegation made there is no other cogent material on the record so as to implicate the petitioner in this case.
Considering the aforesaid facts and circumstances of the case and also that the petitioner has no criminal antecedent, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount to the satisfaction of the Chief Judicial
