Petitioner seeks bail in Special Case No.5780 of 2019 arising out of Fatuha P.S. Case No.422 of 2019 instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Act, 2016.
Counsel for the petitioner submits that there is no recovery of illicit liquor from possession of the petitioner. Recovery has been made from garbage of mango orchard of Rajendra Singh.
Petitioner is in custody since 01.07.2019 having clean antecedents.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner,
Patna High Court CR. MISC. No.49340 of 2019(2) dt.16-08-2019 2/2 above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna, in connection with Special Case No.5780 of 2019 arising out of Fatuha P.S.
