The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 420 and other allied sections of the Indian Penal Code. As per the prosecution case, this petitioner along with co-accused Vinod Kumar received money in the name of sale of land which was already sold in past by the mother of alleged vendors. The petitioner is also witness of the agreement for sale. It is submitted that petitioner is only witness to the agreement for sale. He is neither purchaser nor vendor of the land in question. Petitioner has neither received any single farthing from the complainant nor any amount was transferred

Patna High Court CR. MISC. No.64347 of 2021(7) dt.08-12-2022 2/2 in the account of petitioner. Present FIR has been lodged after month of the alleged occurrence, only to put pressure upon the petitioner.

However, counsel for the State and counsel for the informant vehemently opposed the prayer for bail and submitted that petitioner took money.

Considering the facts aforesaid and the fact that petitioner is only witness of the agreement to sale, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VIII, Patna in connection with Parsa Bazar P.S. Case No. 267 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
