Mr. Bipin Kumar Sinha, SC CBI ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 24-08-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Sections 34/120B/ 409 /420 /467 / 468/471 of the Indian Penal Code. After investigation charge sheet has been submitted under Sections 120B r/w 409/420/ 467 /468 /471 /477A of the Indian Penal Code and Sections 13(1)(c) (d) of the P.C. Act.
Several FIRs were registered for Srijan scandal. The petitioner has been allowed bail in RC2172017A0012 of 2017 by a coordinate Bench of this Court by a detailed and reasoned order.
The same reason is applicable against the petitioner in
Patna High Court CR. MISC. No.10293 of 2021(4) dt.24-08-2021 2/2 this case also as the only material is that the petitioner was conspirator in the scandal alleged.
Mr. Bipin Kumar Sinha, learned counsel for the CBI opposed the prayer for bail.
Considering the facts aforesaid and completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Special Case No.7 of 2019, arising out of CBI/AC-II/New Delhi P.S. Case No. RC2172017A0019 of 2017 with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
