The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 341, 342, 323, 324, 354, 504 of the Indian Penal Code and 3(1)(iv) of SC/ST (Prevention of Atrocities) Act. The prosecution case is that the accused persons came variously armed, assaulted the informant, caused injury on the right hand, tied her with rope and tried to outrage the modesty.

It is submitted by learned counsel for the petitioner that in the background of land dispute the accusation has been levelled. The accusation is omnibus and general. A

Patna High Court Cr.Misc. No.35907 of 2015 (2) dt.04-09-2015 2/2 statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent and similarly situated accused Tunda Murmu and others have been granted anticipatory bail vide Cr. Misc. No. 36947 of 2014. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Azamnagar P.S. Case No. 30 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
