JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-01-2017 The application is for grant of regular bail in connection with Piro P.S. Case No. 237 of 2016 registered for offences under sections 363, 365/34 of the Indian Penal Code and sections 4/6 of the POCSO Act.
It has been submitted on behalf of the petitioner that though there is an allegation against the petitioner that he had kidnapped the victim girl and the statement of the victim girl has been recorded under section 164 Cr.PC. during the course of investigation, which does not support the case of the petitioner. It has also been submitted that there was a love affair between the petitioner and the victim girl and later on, the victim girl due to pressure of her family members, supported the prosecution case. The petitioner is in custody since 05.08.2016.
Patna High Court Cr.Misc. No.55220 of 2016 (3) dt.30-01-2017 2/2 Heard learned A.P.P. also. Learned A.P.P. has opposed the prayer for bail of the petitioner. Having heard both sides. As there is a direct allegation against the petitioner, this Court is not inclined to grant bail to him at this stage. However, the court below is directed to expedite the trial and conclude the same as soon as possible. With the above observation, this petition is dismissed.
