Petitioner, who is in custody, seeks bail in connection with Dhanarua P.S. Case No. 194 of 2018 registered for the offences punishable under Section 302/34 of the Indian Penal Code and under Section 27 of the Arms Act. Informant who is the wife of the deceased has alleged that on 04.06.2018 while his husband was irrigating the plant and she had gone there five FIR named accused came there and specific allegation against Birendra Bind of causing indiscriminate firing upon the husband of the informant as a result of which he died on the spot.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has falsely

Patna High Court Cr.Misc. No.68868 of 2018(2) dt.03-12-2018 2/2 been implicated in this case due to village politics. There is no allegation of any overt act against petitioner except he was present at the time of occurrence. He has no criminal antecedent and he is in custody since 13.07.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Masaurhi, Patna, in connection with Dhanarua P.S. Case No. 194 of 2018.
