The petitioners are languishing in custody for the offences punishable under Sections 147, 149, 341, 323, 324, 325, 326, 354, 307, 506 of the I.P.C. and Section 8 of POCSO Act.
Co-accused Yogendra Paswan and Rajesh Paswan, in a condition of intoxication, misbehaved with the wife of the informant and for that reason in a subsequent occurrence the petitioners and others allegedly committed assault. Learned counsel for the informant opposed the prayer
Patna High Court CR. MISC. No.10348 of 2021(2) dt.30-06-2021 2/2 for bail.
Petitioners are in custody since 04.11.2020. Investigation of the case is already complete. Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with POCSO Case No. 30 of 2020 arising out of Kako P.S. Case No. 171 of 2020, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners. (c) The petitioners shall not leave the country without permission of the trial Court.
