The petitioner seeks bail in Chainpur P.S. Case No. 245 of 2016, registered for the offences punishable under Sections 302, 354 and 34 of the Indian Penal Code.

The petitioner is alleged to have pulled scarf of a girl while he was riding on a motorcycle and in course of such mischief the petitioner met with an accident causing death of that girl. The petitioner also got injuries.

Learned counsel for the petitioner submits that during course of investigation almost all the witnesses have stated that it is a case of accident and no mischief was committed by the petitioner. The police after investigation submitted charge sheet under Sections 304A, 354 and 34 of the Indian Penal Code.

Patna High Court Cr.Misc. No.54914 of 2016 (5) dt.22-03-2017 2/2 Learned APP however opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and nature of allegations made against the petitioner and the fact that the petitioner is in jail since 29.10.2016, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabhua in Chainpur P.S. Case No. 245 of 2016.
