JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2017 The petitioner is in custody since 18.06.2016 in connection with G.R. No. 4/2016/9/2016, registered for offences punishable under Sections 20(b) NDPS Act and 47(a) of Excise Act.

Allegation against the petitioner is of recovery of 57 Kg. Ganja and 17.25 litres English wine.

It has been submitted on behalf of the petitioner that petitioner has nothing to do with the alleged recovery and she has been made accused in this case only on the basis of statement of Khalasi of the Bus, from which the alleged recovery has been made. Further petitioner is a lady and has been in judicial custody since 18.06.2016.

No.16904 of 2017 (2) dt.11-04-2017 2/2 Having heard both sides, considering the facts and circumstances of the case and also that in this case huge quantity of ganja has been recovered along with 17.25 litres of indian made foreign liquor, as such, I am not inclined to grant the petitioner, the privilege of regular bail, it is accordingly rejected. However, the trial court is directed to expedite the trial and try to conclude it within a period of ten months and if the trial is not concluded within the aforesaid period, the petitioner will be at liberty to renew her prayer for bail in the court below itself.
