JUSTICE SANJAY PRIYA ORAL ORDER 14-08-2019 Heard the learned counsel for the petitioner, learned counsel for the Vigilance and the learned A.P.P. for the State. The petitioner seeks bail in Special Case No. 25 of 2019 (arising out of Rajauli Police Station Case No. 208 of 2019), instituted for offence under Sections 384 and 411 of the Indian Penal Code as well as under Section 7(A) of AntiCorruption Amendment Act, 2018. As per allegation in written report, at 6.50 P.M.

he got secret information that at Chitarkoli Check Post Home Guard constable, who is deputed there, is collecting illegal amount from Drivers of truck coming from Jharkhand State.

Patna High Court CR. MISC. No.49288 of 2019(2) dt.14-08-2019 2/2 deputed home guard Jawan was collecting money from truck drivers. An amount of Rs. 650/- was seized from the accused and seizure list was prepared. The copy of seizure list was handed over to petitioner.

It is submitted that the petitioner is on the verge of retirement. Due to institution of the instant case he will be departmentally proceeded also for aforesaid allegation. The petitioner is in custody since 13.06.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance-1st, Patna, in connection with Special Case No. 25 of 2019 (arising out of Rajauli Police Station Case No. 208 of 2019), subject to the conditions that both the bailors shall be the close relatives of the petitioner.
