====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 25-04-2017 Heard learned counsel for the petitioners and learned A.P.P. for the State.

Petitioners are in custody since 16.08.2016 in connection with Udakishunganj P.S. Case No. 86 of 2016 registered under Sections 302, 201/34 of the Indian Penal Code.

Learned counsel for the petitioners has submitted that the petitioners, who are of clean antecedents, happen to be in-laws of the deceased have falsely been implicated in this case. In fact, these petitioners have been made accused in this case merely on the basis of suspicion, which is evident from the F.I.R. itself. There is no eye witness to the alleged occurrence nor any independent witnesses came forward to support the prosecution version. These petitioners are in custody for the last seven months.

Patna High Court Cr.Misc. No.5699 of 2017 (3) dt.25-04-2017 Considering the nature of accusation, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) each with two sureties of the like amount each to the satisfaction of the learned Sub- Divisional Judicial Magistrate, Udakishunganj, Madhepura in connection with Udakishunganj P.S. Case No. 86 of 2016.
