1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 137(2), 96, 143(4) and 3(5) of the BNS, 2023 read with Sections 8 and 12 of the POCSO Act.

3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioner nos. 1 and 3 are women and the informant alleges that Manish took her on a motorcycle on the pretext that her mother was ill and

No.53676 of 2025(2) dt.20-08-2025 2/3 admitted in a hospital at Biharsharif and brought to his sister Rinki's in-laws house and locked her in a room, further when Victim opened the door, she saw that Manish parents were present there, further the informant on coming to know, reached the place of occurrence and the victim was rescued from the house with the help of police, but in the meantime, the accused persons had fled.

4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that the FIR does not inspire confidence, as it does not appear probable that petitioner nos. 1 and 2 who are mother and father of Manish would have gone to the house of petitioner no. 3 i.e. Rinki on coming to know that Manish had kidnapped the daughter of the informant. It is next submitted that Manish and the daughter of the informant were in love and the victim on her own volition had accompanied him, but then in order to coerce Manish into submission, his entire family members have been implicated.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the

No.53676 of 2025(2) dt.20-08-2025 3/3 event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Mahila P.S. Case No. 81 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.

7. Accordingly, the instant anticipatory bail application stands allowed.
