This application, for grant of anticipatory bail, arises out of Patepur Police Station Case No. 169 of 2020, disclosing offences under Sections 399, 402, 411, 412, 414, 420/34 of the Indian Penal Code.
As per allegation, three persons were arrested and some arms and psychotropic substance (Charas) was recovered from their possession.
The learned counsel for the petitioner has submitted that petitioner was neither arrested on spot nor anything was recovered from his conscious possession. There is nothing incriminating against him except confessional statement of co-
Patna High Court CR. MISC. No.10190 of 2021(2) dt.22-12-2021 2/2 accused, Md. Yasin. He has also submitted that the petitioner is a person of clean antecedent.
Learned Addl. P.P. has opposed and the prayer for bail.
Considering the aforementioned fact and circumstances, let the petitioner, named above, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Vaishali, in connection Patepur Police Station Case No. 169 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
