The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 392 of the Indian Penal Code.

As per prosecution case, the allegation against the accused persons including the petitioner is that snatched cash bag from the informant in which total 1,25,000/- cash was kept.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case merely on the basis of suspicion. The petitioner has no concern with the alleged occurrence and nothing looted money has been recovered

No.54255 of 2023(2) dt.28-08-2023 2/2 from his conscious possession rather looted money was recovered from co-accused, namely, Anik Kumar Yadav and the petitioner was sitting behind the co-accused due to which he has been made accused in this case. It is further submitted that the petitioner is languishing in judicial custody since 21.04.2023.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Khagaria (Chitragupta Nagar) P.S. Case No. 411 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM Khagaria.
