Informant's brother, a shopkeeper while was opening his shop was shot dead. During course of investigation, it has been stated by some of the witnesses that on account of parking of tempo there was an altercation amongst Deepak with the deceased. Petitioner happens to be cousin brother of Deepak. However, nothing substantial has been collected during course of investigation save and except inculpatory confessional statement of all the co-accused and that being so, petitioner Rahul Kumar Upadhyay @ Rahul Upadhyay is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Pirbahore P.S. Case No.98 of 2016.
