The petitioner being the husband of the granddaughter of the complainant is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A/34 of the Indian Penal Code.

The basic accusation is of torture.

It is submitted by learned counsel for the petitioner that the petitioner's wife, the grand-daughter of the complainant has already died.

Considering the fact that the police case was lodged in 2008, on conclusion of investigation final form was submitted and, thereafter, process has been directed to be issued

Patna High Court Cr.Misc. No.33953 of 2015 (2) dt.14-08-2015 2/2 on a protest-cum-complaint after cognizance being taken in 2011 and the wife of the petitioner has died, let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Complaint Case No.744 of 2011, pending before the learned Judicial Magistrate, 1st Class, Bikramganj, Rohtas.

With the above observation, this application is, accordingly, disposed off.
