JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-11-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

Petitioner happens to be co-villager of the informant but even then petitioner is not named in the F.I.R. which has been lodged in respect of commission of dacoity. However, the impugned order goes to show that in course of investigation some prosecution witnesses claimed to have seen the petitioner near the place of occurrence in suspicious condition and on that basis petitioner was arrested and confessed his guilt.

No.65956 of 2018(2) dt.22-11-2018 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that some co-accused, having more or less similar allegation, have already been granted privilege of bail by different Benches of this Court, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda, Bihar Sharif in connection with Rajgir P.S.
