JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-08-2015 Heard learned counsels for the petitioner and the State. The petitioner being Deputy Branch Manager of Harnaut branch in Punjab National Bank, Nalanda is apprehending arrest in a case registered for the offences punishable under Section 406, 419, 420, 467, 468, 120B/34 of the Indian Penal Code.

The prosecution case is that the informant opened saving bank account in the branch of the petitioner but subsequently he came to know that heavy transaction has been routed through the account of the petitioner in connivance with the petitioner and others.

It is submitted by learned counsel for the petitioner that huge amount with regard to loan accounts were transferred to the account of the informant and it was withdrawn by the informant

Patna High Court Cr.Misc. No.34689 of 2015 (2) dt.17-08-2015 2/2 in connivance with the bank officials when the then Deputy Manager B. K. Lal lodged Harnaut P.S. Case No.269 of 2013 and much thereafter the informant lodged the present case. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts and lodging of the case at earlier point of time, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Biharsharif in connection with Harnaut P.S. Case No.197 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
