1. Heard learned counsel for the petitioner and learned AC to GP-18 and the learned counsel appearing on behalf of the private respondent.

In the nature of relief sought for in the instant writ application, the Court finds no merit in the writ application, as such, it is dismissed, as from bare perusal of the prayer made in the writ application, it would manifest that the petitioner is seeking relief against a private person, further the counter affidavit correctly records that the dispute is in between two private individuals and the land in dispute does not come in the

Patna High Court CWJC No.13831 of 2022(2) dt.17-03-2025 2/2 category of public land, hence encroachment proceeding cannot be initiated on the land in question under Bihar Public Land Encroachment Act, 1956.

3. The writ application is dismissed.
