This case has been given a priority hearing on the insistence of the learned counsel for the petitioner for the reason that the husband of the deceased has been acquitted and almost all the accused persons of this case have been released on bail. It has further been submitted that the husband of the petitioner stays abroad and the petitioner apprehends arrest anytime. The petitioner seeks bail in anticipation of her arrest in connection with Pachrukhi P.S. Case No. 135 of 2019 instituted for the offences under Sections 304B/201/34 of the Indian Penal Code.

Though the petitioner has been named in the F.I.R. with specific accusation but it appears that such accusation has

Patna High Court CR. MISC. No.63244 of 2021(2) dt.18-05-2022 2/2 been hurled only because the deceased had died and a case had been filed for such death and the informant was of the impression that the relationship between the families had been snapped.

Be that as it may, regard being had to the fact that the husband of the deceased has been acquitted for want of evidence and some of the other similarly situated accused persons have been granted bail, the petitioner, above named, is also directed to be released on bail, in the event of her arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Pachrukhi P.S. Case No. 135 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
