Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 323, 324, 341, 354, 427, 448, 504, 506, 34 of the Indian Penal Code.
It is alleged that petitioners along with other accused entered into the house of the informant, dragged the informant, torn her cloths and snatched cash, jewellary and mobile of the informant. The accused persons also assaulted the daughter of the informant when she came to rescue the informant.
It is submitted by learned counsel for the petitioners that petitioners being neighbour of the informant have been roped in the present case due to the petty land
Patna High Court Cr.Misc. No.33873 of 2015 (2) dt.13-08-2015 2/2 dispute. One of the co-accused Dhoni Devi gave a written complaint against the informant to the local Sarpanch which was forwarded to the Kishanganj P.S but no F.I.R was lodged. The informant was never been medically examined and there is no injury report on the record.
A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case No. 144 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
