The petitioner seeks quashing of the order dated 13.10.2009 passed in Misc. Case No.02/2008-09 by the D.C.L.R., Danapur, Patna.
It appears that the petitioner purchased the land from Raghunath Prasad and the D.C.L.R., without hearing the petitioner, ordered for mutation of the name of the respondents. It appears that against the order passed by the Circle Officer on 06.01.2009. Raghunath Prasad, the vendor of the petitioner filed appeal before the
Patna High Court CWJC No.2166 of 2017 dt.13-03-2018 2/2 D.C.L.R. The vendor of the petitioner filed C.W.J.C. No.1479/2010 against the order dated 13.10.2009 passed by the D.C.L.R. in Misc. Case No.02/2008-09 and this court vide order dated 30.06.2015 transmitted the records to Bihar Land Tribunal for adjudication of the dispute between Raghunath Prasad and others. The Bihar Land Tribunal vide its order passed in B.L.T. Case No.942/2015 dismissed the case of Raghunath Prasad on 06.12.2016. Thereafter the petitioner, who is purchaser from Raghunath Prasad filed this writ petition challenging the illegality of the order of the D.C.L.R. which has already been found to be correct in the case filed by the vendor of the petitioner.
Considering the aforesaid facts, I do not find any merit in the writ petition. The same is dismissed.
