Petitioner being lady is in jail custody since 25.6.2016 in a case initially, registered under section 307 and other minor sections of the Indian Penal Code but subsequently, section 302 of the Indian Penal Code was also added.

Informant claims that FIR named accused Dinesh Pd. Singh and three others started demolishing her boundary wall of the house and when her husband and sons forbade them to do so, the aforesaid Dinesh Pd. Singh and three others started assaulting her sons and husband. Informant also said that the petitioner and two others came later on and they, too, participated in the occurrence. Informant's husband died in course of his treatment and post mortem report of the deceased goes to show that only two injuries were found on his person.

Patna High Court Cr.Misc. No.42139 of 2016 (3) dt.04-10-2016 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in Shambhuganj P.S. Case no. 78/2016.
