Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Patepur P.S. Case No. 152 of 2021 registered for offence punishable under sections 341, 323, 307, 379, 504, 506/34 of the Indian Penal Code.

The specific allegation against the petitioner is that he assaulted the informant on his head with dab. The learned counsel for the petitioner has submitted that accused no. 5, Anjali Devi had lodged a case against the prosecution side prior to lodging of the present case, as the accused persons in that case outraged her modesty. Patna High Court CR. MISC. No.63136 of 2021(2) dt.19-07-2022 2/2 counsel for the petitioner has submitted further that the injuries suffered by the informant, are simple in nature and the petitioner is a person of clean antecedent.

The learned A.P.P., Mr. Jharkhandi Upadhyay has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances as well as the clean antecedent of the petitioner, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Patepur P.S. Case No. 152 of 2021, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
