The petitioner apprehends his arrest in Obra P.S. Case No.75 of 2019 registered under Section 307 and other sections of the Indian Penal Code.

The informant alleged that her daughter-in-law was chiding her daughter in the field of high School but the wife of Dwarik, Jodhan Paswan, his wife, Dilkeshwar Paswan, Guddu Paswan, Basant Paswan and Ravindra Paswan (petitioner) came and alleged to have assaulted the daughter-in-law of the informant. When the informant and her daughter came to save, the accused persons also assaulted them.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the case. No specific allegation of assault is made against the petitioner, but from

No.48875 of 2019(2) dt.06-08-2019 2/2 perusal of injury reports of the injured, it appears that the informant, her daughter-in-law and her daughter got superficial injuries which may have caused on account of scuffle. Having considered the facts and the nature of allegation made against the petitioner and the fact that the injuries found on the persons of the injured are simple and superficial in nature, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Obra P.S. Case No.75 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
