The application is for grant of bail in connection with Palasi P.S. case no. 12 of 2016 for the offence under Sections 302, 307 and other sections of the Indian Penal Code. It is submitted on behalf of petitioner that there is a case and counter case between the parties and injury report shows that injuries are simple in nature. It is further submitted that there is no allegation against the petitioner of assaulting the deceased and petitioner is in custody for about three months. Heard learned A.P.P. and learned counsel for informant also. They have opposed the prayer for bail. Having heard both sides. In view of the fact that

No.49756 of 2016 (3) dt.12-01-2017 2/2 there is no allegation of assault against the petitioner on the deceased and allegation of assault of some other person against the petitioner and, for which, petitioner has remained in custody for about three months, the bail application of petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate IV, Araria in connection with Palasi P.S. case no. 12 of 2016 with a condition that he will cooperate in the trial and make himself available as and when required except on some genuine reason.
