Mr.Raj Ballabh Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 25-01-2023 The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month.

Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Saharsa (Mahila) P.S. Case No. 29 of 2022, registered for the offences punishable under Sections 341, 323, 498(A), 504, 506/34 of the Indian Penal Code.

As per allegation, the informant was married to the petitioner in the year 2020. The cash and customary presents were given at the occasion of the marriage. The accused persons

Patna High Court CR. MISC. No.52823 of 2022(2) dt.25-01-2023 2/2 demanded dowry mentioned in the FIR. On expressing inability to fulfill the demand, she was tortured and was assaulted badly. The learned counsel for the petitioner has submitted that he is innocent and ready to keep the victim with full dignity and honour.

On the other hand, the learned counsel for the informant has submitted that severe atrocities were inflicted on the victim by the petitioner. As such, it was not possible for her to reside with him. He has also submitted that due to badly assault, given by the petitioner, the victim was admitted in hospital in I.C.U. ward.

In my view, it is not a fit case for anticipatory bail. Accordingly it is rejected.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
