The petitioner apprehends his arrest in connection with Bishambharpur P.S. Case No.152 of 2023, registered for the offences punishable u/s 302, 34 of the Indian Penal Code. 3.

As per the FIR, petitioner along with other co-accused persons killed the daughter of informant on the pretext of nonfulfillment of demand for dowry. 4.

It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. Petitioner is the father-in-law of the deceased and there is no specific overt act against him. He further submitted that as per postmortem report

Patna High Court CR. MISC. No.57673 of 2024(2) dt.11-09-2024 2/2 of deceased, the doctor has not found any external injury over the body of the deceased and cause of death is Asphyxia due to hanging. Petitioner has no criminal antecedent 5.

Learned APP for the State opposed the prayer for bail. 6.

Having regard to the facts and circumstances of the case as well as considering the nature of offence, I am not inclined to grant anticipatory bail to the petitioner. The prayer for bail on his behalf is hereby rejected.

Accordingly, this application is dismissed.
