JUSTICE RAKESH KUMAR ORAL ORDER 06-10-2016 Heard Sri Amresh Kumar Sinha, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 26.06.2016 in Bhairabsthan P.S. Case No.66/2016 registered for the offence under Sections 25(1-B)/26/35 of the Arms Act, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that on false accusation of recovery of one magazine containing two live cartridges, the petitioner has been made accused. Learned counsel for the petitioner has drawn attention to the statement made in paragraph-3 of the petition to show that the petitioner is having clean antecedent, whereas learned Addl. Public Prosecutor, opposing the prayer for bail of the petitioner,
Patna High Court Cr.Misc. No.42946 of 2016 (2) dt.06-10-2016 2/2 submits that the petitioner was travelling in a vehicle, in which one dreaded criminal, Bhima Yadav was apprehended along with others and from their possession, two loaded pistols and cartridges were recovered.
After hearing learned counsel for the parties and considering the period of custody, nature of accusation as well as clean antecedent of the petitioner, let the petitioner, namely, Chandra Gupta Sah, be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Madhubani in connection with Bhairabsthan P.S. Case No.66/2016. (Rakesh Kumar, J) NKS/- U T
