Mr. Singh seeks permission to withdraw the application with respect to petitioner No. 1, namely, Suresh Prasad, who has been arrested.

Patna High Court CR. MISC. No.10431 of 2021(3) dt.31-03-2022 2/3 Permission is granted.

The application with respect to petitioner No. 1 is dismissed as withdrawn as having become infructuous. The petitioner Nos. 2 and 3 seek bail in anticipation of their arrest in connection with Hilsa P.S. Case No. 140 of 2020, dated 18.03.2020, instituted for the offences under Sections 341, 323, 504, 307 and 379/34 of the Indian Penal Code.

The petitioner No. 2 is said to have given orders, whereas the petitioner No. 3 is said to have assaulted one Lallan, who has received only simple injuries. The informant is said to have been assaulted by petitioner No. 1, who has now been arrested and his application has become infructuous.

This Court had called for the case diary vide order dated 21.02.2022 and had granted provisional bail to petitioner Nos. 2 and 3.

The case diary has since been received.

Regard being had to the fact that petitioner No. 2 is an order-giver, whereas petitioner No. 3 has causing

Patna High Court CR. MISC. No.10431 of 2021(3) dt.31-03-2022 3/3 simple injuries to one Lallan, the provisional bail granted to them is, hereby, confirmed. They shall remain on the same bail bonds.
