Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 147, 149, 341, 323, 308, 504 and 506 of the Indian Penal Code, registered in connection with Rajgir P.S.Case No. 299 of 2021.

As per allegation, when the son of the informant was sitting near the railway line, the petitioners along with other co-

Patna High Court CR. MISC. No.63226 of 2021(2) dt.19-07-2022 2/3 accused Rahul Kumar and Sunil Chaudhary and 10-15 unknown persons came there and badly assaulted his son with iron rod etc. Co-accused Rahul Kumar assaulted on his head and petitioner no.2 also assaulted him.

The learned counsel for the petitioners has submitted that petitioners are the persons of clean antecedents. As a matter of fact, petitioners were tenants of the informant and the informant disconnected the electricity line. As such, they vacated the premises belonging to the informant and it is the reason that they have been falsely implicated in this case. He has submitted further that the injuries suffered by the injured Ankush Kumar are simple in nature.

On the other hand, the learned APP has opposed the prayer for anticipatory bail.

Considering the above facts and circumstances, especially the clean antecedents of the petitioners, let them above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of CJM, Nalanda at Biharsharif in connection with Rajgir P.S.Case No. 299 of 2021, subject to the conditions as

Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
