JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 12-07-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner wants to renew his prayer for bail which was earlier rejected by order dated 13.07.2016 passed in Cr. Misc. No. 22876 of 2016 on the ground that the petitioner is in custody since 30.09.2015 and up till now four prosecution witnesses have been examined out of whom three have not supported the prosecution version and as such the petitioner deserves sympathetic consideration.

The learned A.P.P. opposes prayer for bail of the petitioner by submitting that the petitioner is the assailant and the postmortem report is consistent with the prosecution version. In the facts and circumstances as stated above, finding

Patna High Court Cr.Misc. No.20360 of 2017 (3) dt.12-07-2017 2/2 no good ground for reconsideration of prayer for bail, again prayer for bail of the petitioner stands rejected in connection with Dulhin Bazar P.S. Case No. 141 of 2015 pending in the court of A.C.J.MIII, Danapur, District- Patna. However, considering detention of the petitioner, let the trial be expedited and concluded as early as possible preferably within a period of six months.
