JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-02-2017 The petitioner is in custody since 25.07.2016 in connection with Tedhagachh P.S. Case No. 25 of 2007, registered for offences punishable under Section 395 of the Indian Penal Code It has been submitted on behalf of the petitioner that petitioner has been falsely implicated in this case only on the basis of suspicion and though some witnesses has identified the petitioner but other co-accused has already been granted bail and the petitioner has been languishing in judicial custody since 25.07.2016 Heard learned A.P.P. also.
Having heard both sides, in view of the fact that witnesses have identified the petitioner to be involved in the
Patna High Court Cr.Misc. No.54854 of 2016 (5) dt.08-02-2017 2/2 alleged offence and the petitioner has criminal antecedent as he is accused in as many as 24 cases, I am not inclined to grant him, the privilege of regular bail, it is accordingly rejected. Learned trial court is directed to expedite the trial and try to conclude it within a period of one year and if the trial is not concluded within the aforesaid period, the petitioner will be at liberty to renew his prayer for bail in the court below itself. Superintendent of Police Kishanganj, is directed to ensure the production of the witnesses on the dates fixed regularly so that the trial can be disposed of within time.
