The petitioner seeks bail in Madanpur P.S. case No. 84 of 2016 under Section 47 of Bihar Excise Amendment Act. The police got information that some illicit liquor was being carried in a Maruti Swift car. On such, one car was intercepted from which about 450 liters of country made liquor was recovered.
The learned counsel for the petitioner submits that although petitioner is driver of the vehicle but he has not been arrested on the spot. The petitioner has got no criminal antecedent and he is in jail since 06.08.2016.
Considering the facts aforesaid and the fact that petitioner has already remained in jail for about seven months, the
Patna High Court Cr.Misc. No.54888 of 2016 (3) dt.28-02-2017 2/2 above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Madanpur P.S. Case No. 84 of 2016.
