JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20.09.2017 Heard learned counsel for the petitioner as well as learned counsel for the Vigilance.

Medical Board has submitted its report and from perusal of the report of Medical board, it would appear that the petitioner is suffering from only hypertension etc. and, therefore, in my view, petitioner does not have any serious ailment which could not be treated within the premises of the jail and, therefore, taking note of the aforesaid facts as well as allegation levelled against the petitioner, I am not inclined to release the petitioner on bail on the ground mentioned by me in my previous order dated 8.11.2016 passed in Cr. Misc. no 33957/2016 and accordingly, again,

Patna High Court Cr.Misc. No.24503 of 2017 (4) dt.20-09-2017 his prayer for bail in connection with Special case no. 25/2016 arising out of Buxer (Town) P.S. Case no. 181/2016 pending in the court of Special Judge Vigilance, I, Patna stands rejected.

However, learned trial court is directed to conclude the trial of the petitioner within six months from the date of receipt/production of a copy of this order and if trial court fails to conclude the trial of the petitioner within the above stated period due to laches of the prosecution, petitioner may renew his payer for bail before the trial court itself. shahid (Hemant Kumar Srivastava,J) U T
