2. The petitioner seeks bail in connection with Tajpur P.S. Case No. 88 of 2025 dated 09.06.2025 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. As per the prosecution case, total 673.500 litres of illicit foreign liquor was recovered from the Scorpio Vehicle which was driven by the co-accused Vishwanath Kumar and 295.89 litres of illicit foreign liquor was recovered from the Bolero vehicle which was driven by Ritik Raushan (petitioner).

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

It is further submitted that the petitioner is neither the owner nor the driver of the seized Scorpio and Bolero vehicles in question and he has also no concern with the seized illicit liquor. The police has arrested the petitioner only on the basis of the disclosure made by the co-accused Vishwanath Kumar that the petitioner is the driver of Bolero vehicle bearing Registration No. BR09PA-152 from which 295.890 litres of foreign liquor was recovered. There is no statutory compliance of Section 105 of the B.N.S.S., 2023. It is further submitted that the other co-accused person, namely, Vishwanath Kumar @ Vishnath Kumar has already been granted bail by a Bench of this Court in Cr. Misc. No. 45676 of 2025 vide order dated 16.07.2025. The petitioner has three criminal antecedents in which he is on bail as stated in paragraph no. 3 of the bail petition. The petitioner is in custody in this case since 09.06.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of

Patna High Court CR. MISC. No.53816 of 2025(2) dt.07-08-2025 3/3 the like amount each to the satisfaction of learned Special Judge, Excise Act, Court No.-II, Samastipur in connection with Tajpur P.S. Case No. 88 of 2025.
